By engaging the services of Xaurora AB, submitting a purchase request, placing a bid, paying a deposit, or otherwise participating in the sourcing or purchasing process, the customer acknowledges and agrees to be bound by these Terms and Conditions whether they have read them or not.
Xaurora AB provides vehicle sourcing, inspection coordination, and import facilitation services for Japanese collector vehicles. Vehicles sourced through Xaurora AB may originate from Japanese dealer inventories, private sellers, auction houses, or export companies. In most cases the vehicles are not in the physical possession of Xaurora AB prior to export. Vehicle descriptions, grading sheets, photographs, specifications, and other information provided through auction platforms or dealers are created by those parties and are not produced directly by Xaurora AB. Xaurora AB acts as a sourcing specialist with direct presence in Japan, working closely with local dealers and partners to identify, secure, and acquire vehicles before they reach the broader international market. Xaurora AB acts as a coordinator and facilitator of services unless explicitly stated otherwise. For vehicles imported into Sweden, Xaurora AB coordinates and manages the import process locally. For other destinations, Xaurora AB coordinates export and international shipping, while import procedures, local handling, and registration remain the responsibility of the buyer.
Vehicles sourced through Xaurora AB are often collector vehicles and may be several decades old. Due to the age and nature of these vehicles, cosmetic wear, mechanical aging, and imperfections should be expected. The buyer acknowledges that collector vehicles may require servicing, maintenance, or replacement of consumable parts upon arrival.
All vehicles are purchased strictly as-is based on the information available at the time of purchase. Xaurora AB does not provide any mechanical warranty or guarantee regarding the condition of the vehicle unless explicitly agreed upon in writing. The buyer accepts that the condition of the vehicle may differ from expectations due to the nature of used and collector vehicles.
Vehicle information including mileage readings, service history, accident history, vehicle specifications, and auction grading is provided by third parties such as auction houses, sellers, or inspection companies. Xaurora AB relies on this information but cannot independently verify all details.
At the request of the customer, Xaurora AB may arrange an independent third-party vehicle inspection through professional inspection providers. These inspections are conducted by independent entities and Xaurora AB relies on the findings and reports provided by those inspectors. Xaurora AB carefully reviews and relies on these reports as part of its sourcing process, but as they are prepared by independent inspectors, they may not capture every detail.
All purchase decisions remain the sole responsibility of the customer. When a customer instructs Xaurora AB to place a bid, negotiate a purchase, or secure a vehicle, the customer confirms their intention to complete the transaction. Bids and purchase decisions are made based on the information available at the time of bidding.
When a customer instructs Xaurora AB to place a bid, negotiate, or secure a vehicle purchase on their behalf, such instruction shall be considered irrevocable once the bid has been submitted or the purchase has been confirmed with the seller or auction house. The customer acknowledges that Xaurora AB acts on the customer’s behalf and that once the purchase process has been initiated, the customer remains fully responsible for completing the transaction. Prior to a bid being placed or a purchase being confirmed, the customer may withdraw their request without penalty.
A deposit is required in order to secure the services of Xaurora AB and confirm the buyer’s intent to proceed with a vehicle purchase. Deposits may be applied toward the final purchase price of the vehicle. Once a vehicle has been purchased or reserved on behalf of the customer, the deposit becomes non-refundable. Refunds may only be issued prior to purchase and may be subject to transaction or banking fees.
Following the successful purchase of a vehicle, a proforma invoice will be issued to the customer. Full payment must normally be completed within two to three business days unless otherwise agreed in writing. Failure to complete payment within the required timeframe may result in cancellation of the purchase and forfeiture of the deposit.
Xaurora AB reserves the right to request verification of the source of funds used for any transaction. If the source of funds cannot be reasonably verified, Xaurora AB may suspend or cancel the transaction.
If the customer fails to complete payment after a vehicle has been purchased or secured on their behalf, the customer agrees to reimburse Xaurora AB for any losses, fees, administrative costs, auction penalties, transport costs, storage costs, currency losses, or other expenses incurred as a result of the failed transaction. Xaurora AB reserves the right to invoice the customer for such costs. The buyer remains responsible for any costs incurred up to the point of cancellation.
In the event that a customer fails to complete payment within the agreed timeframe, Xaurora AB reserves the right to cancel the transaction and resell the vehicle in order to recover costs associated with the purchase, storage, transport, and administrative work related to the transaction. Any financial loss resulting from the resale may be charged to the original customer.
Ownership of the vehicle transfers to the buyer once the vehicle has been purchased on behalf of the buyer and full payment has been received by Xaurora AB. Risk associated with the vehicle, including storage and transport risks, transfers to the buyer once the vehicle has been secured for export.
Upon request, the buyer may choose to purchase transport insurance arranged through the shipping provider or logistics partner. Such insurance, if purchased, may transfer certain transport-related risks to the shipping provider or insurer according to the terms of the insurance policy. Risk transfers once the vehicle has been handed over to the shipping provider. Xaurora AB acts solely as a facilitator for arranging such insurance and does not assume liability under the insurance policy.
Vehicle specifications, accessories, spare parts, or optional equipment listed in auction listings or seller descriptions may vary. Xaurora AB cannot guarantee the presence of specific accessories or components unless confirmed in writing prior to purchase.
Xaurora AB sources vehicles based on the buyer’s requested criteria. However, due to market availability, exact matches may not always be possible.
The buyer acknowledges that vehicles may be presented that are close to, but not identical with, the original request in terms of model year, mileage, specification, or condition.
Xaurora AB fulfills its sourcing obligation by identifying and presenting suitable vehicles that reasonably match the buyer’s criteria based on market availability.
Vehicle purchases may involve multiple currencies including Japanese Yen, Swedish Krona, Euro, or United States Dollar. Exchange rates may fluctuate between the time of inquiry and the time of purchase. The buyer accepts responsibility for any price differences caused by currency fluctuations.
Vehicles are exported and transported through third-party logistics providers, including shipping companies, port operators, transport carriers, export agents, and local partners engaged as part of Xaurora AB’s sourcing operations in Japan. Delivery timelines are estimates only and may vary depending on shipping schedules, port congestion, customs procedures, weather conditions, or logistical disruptions. Xaurora AB shall not be held responsible for delays caused by third-party transport providers.Xaurora AB will make reasonable efforts to coordinate shipping and logistics efficiently but cannot guarantee specific shipping dates or transit times.
Additional inland transport costs may occur due to circumstances including but not limited to non-drivable vehicles, remote seller locations, limited carrier availability, vehicle size restrictions, or transport limitations. The buyer agrees to cover any additional costs required to transport the vehicle to the export port.
The buyer acknowledges that additional costs may arise during the sourcing and export process including but not limited to port handling charges, documentation fees, transport adjustments, storage costs, customs procedures, or changes in shipping arrangements. Xaurora AB reserves the right to invoice the buyer for reasonable additional costs required to complete the transaction when such costs are outside the direct control of Xaurora AB.
All price estimates, shipping estimates, and transport estimates provided by Xaurora AB are indicative only and may change due to market conditions, logistics availability, currency fluctuations, or third-party pricing adjustments.
Vehicles may be stored at export yards prior to shipment. Export facilities may provide a limited free storage period depending on their policies. If shipment is delayed or vessel space is unavailable, storage fees may apply. Such costs are determined by the export facility and must be paid by the buyer.
The buyer is solely responsible for ensuring compliance with all import regulations in the destination country. This includes customs duties, taxes, emissions standards, vehicle registration requirements, and safety regulations. Xaurora AB may assist with documentation but does not guarantee that the vehicle will be eligible for registration in the buyer’s country.
Xaurora AB shall not be liable for circumstances beyond its control including errors made by auction houses, inaccurate inspection reports, transport damage, shipping delays, mechanical failures, corrosion, missing accessories, customs issues, or exchange rate fluctuations.
Vehicles that have been transported or stored for extended periods may require inspection and servicing prior to normal operation. The buyer is responsible for performing reasonable checks and maintenance upon arrival before operating the vehicle.
The buyer acknowledges that they have not materially relied on any statements, opinions, advice, or representations made by Xaurora AB outside of the written documentation provided during the purchasing process. Any informal communication including emails, messages, or verbal discussions shall not constitute a guarantee or warranty regarding the vehicle.
These Terms and Conditions constitute the entire agreement between Xaurora AB and the customer and supersede any prior written or verbal communications regarding the services provided.
Xaurora AB shall not be held liable for any delay, failure, or inability to perform its obligations where such delay or failure arises from events beyond its reasonable control.
Such events may include, but are not limited to, natural disasters, acts of war, terrorism, civil unrest, strikes, labor disputes, port congestion, shipping delays, governmental actions, regulatory changes, pandemics, or disruptions affecting transport, logistics, or supply chains.
In the event of a force majeure situation, Xaurora AB will make reasonable efforts to inform the buyer and resume performance as soon as reasonably possible. Any delays resulting from such events shall not constitute a breach of agreement. Xaurora AB shall not be responsible for any costs, losses, or delays incurred as a result of such events.
Xaurora AB may use photographs taken during sourcing, inspection, export, or delivery for marketing, promotional material, and website content, unless agreed otherwise. Customer identities and confidential transaction details will not be disclosed without prior consent.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions shall be governed by the laws of Sweden. Any disputes arising from these Terms shall be handled by the appropriate courts of Sweden unless otherwise agreed in writing. Both parties agree to act in good faith and to make reasonable efforts to resolve any disputes or misunderstandings before pursuing formal legal action.
The customer agrees not to publish or distribute any false, misleading, or defamatory statements regarding Xaurora AB, its services, employees, or business partners. In the event of a dispute or misunderstanding, both parties agree to first attempt to resolve the matter in good faith through direct communication before making public statements that could harm the reputation of either party. This clause does not prevent honest reviews or personal opinions but applies specifically to knowingly false or misleading statements.
Xaurora AB reserves the right to modify or update these Terms and Conditions at any time. Updated terms shall become effective once published.
